Benedetti insiste en una consulta popular por decreto
El ministro del Interior de Armando Benedetti, reavivó el debate sobre la posibilidad de convocar una consulta popular sin el respaldo del Congreso, argumentando que el presidente Gustavo Petro podría hacerlo por decreto ante supuestas irregularidades en el trámite legislativo.
A través de un mensaje en redes sociales, Benedetti aseguró que, según la interpretación de dos expresidentes de la Corte Constitucional, el mandatario estaría facultado para convocar la consulta directamente, amparándose en omisiones del Senado frente a la iniciativa presentada el 1 de mayo.
El gobierno sostiene que la Mesa Directiva del Senado no leyó, como exige el reglamento, la proposición con la que se solicitaba el aval para la consulta antes de la votación. Este detalle, según la interpretación oficial, dejaría sin validez el resultado del debate legislativo.
Benedetti respalda su argumento en el artículo 125 de la Ley 5ª, que rige el procedimiento del Congreso y establece que “cerrada la discusión se dará lectura nuevamente a la proposición que haya de votarse”. Según el gobierno, el Senado tenía un plazo de 30 días para pronunciarse, el cual venció el 1 de junio. En consecuencia, el Ejecutivo tendría hasta el 9 de junio para emitir el decreto y convocar oficialmente a las urnas.
Desde el Congreso, sin embargo, la respuesta ha sido clara. El presidente del Senado, Efraín Cepeda, dirigió una carta al presidente Petro en la que reiteró que la consulta fue votada y rechazada, con un resultado de 49 votos en contra y 47 a favor.
Este no es el primer caso en que una consulta popular se ve envuelta en cuestionamientos procedimentales. En 2018, durante la aprobación de la consulta anticorrupción, tampoco se leyó la proposición previa a la votación. No obstante, en ese entonces la consulta fue aprobada y posteriormente convocada, sin que se interpusieran demandas por esa omisión.
La controversia actual reabre el debate sobre los límites del Ejecutivo en materia de participación ciudadana y el rol del Congreso como filtro institucional. A medida que se acerca el 9 de junio, la tensión entre el gobierno y el legislativo podría escalar, con consecuencias políticas y jurídicas aún por definirse.
